Welcome to Holy Funds. These Terms of Use govern your access to and use of the Holy Funds website, platform, research tools, portfolio analytics, simulations, educational content, strategy research modules, and AI-assisted platform features, including Cyra.

By accessing or using Holy Funds, you agree to these Terms of Use. If you do not agree, you must not use the platform.

1. About Holy Funds

Holy Funds is a research-oriented investment technology platform. The platform provides users with access to institutional-style research tools, portfolio construction frameworks, simulations, analytics, educational materials, strategy research, and AI-assisted explanations through Cyra.

Holy Funds is designed to help users understand portfolios, risk, diversification, investment themes, asset allocation concepts, and quantitative portfolio construction methods. The platform is intended for research, education, analysis, simulation, and self-directed exploration.

Holy Funds does not provide regulated investment advice, personal recommendations, discretionary portfolio management, brokerage services, custody services, execution services, tax advice, legal advice, or financial planning services.

2. Research and Educational Purpose Only

All content, tools, analytics, simulations, portfolio examples, strategy descriptions, model outputs, risk metrics, charts, forecasts, explanations, and AI-generated responses made available through Holy Funds are provided for informational, research, educational, and analytical purposes only.

You are solely responsible for your own investment decisions.

3. No Investment Advice

Holy Funds does not assess your full personal financial situation, investment objectives, risk tolerance, investment horizon, liquidity needs, tax position, legal status, or other personal circumstances in a manner required for regulated investment advice.

Any portfolio, strategy, model, simulation, research output, allocation, comparison, ranking, risk score, or explanation shown on the platform is not a personal recommendation and should not be treated as one.

Even where the platform allows you to input preferences, select risk levels, compare strategies, use optimisation tools, or interact with Cyra, such features are provided to support research and self-directed analysis, not to determine what is suitable for you personally.

4. Cyra AI Assistant

Cyra is an AI-assisted research and platform navigation feature. Cyra may help explain portfolio concepts, platform tools, research outputs, simulations, risk metrics, strategy logic, and market-related information.

Cyra does not act as your financial adviser, portfolio manager, broker, fiduciary, tax adviser, legal adviser, or personal wealth manager. Cyra’s responses are generated by artificial intelligence and may be incomplete, outdated, inaccurate, or unsuitable for your circumstances.

You must not rely on Cyra as the sole basis for any investment, financial, legal, tax, or business decision. You are responsible for independently verifying any information provided by Cyra before acting on it.

Cyra may assist with research interpretation, but Cyra does not guarantee investment outcomes, predict future performance, or provide personalised financial advice.

5. Portfolio Tools and Simulations

Holy Funds may provide portfolio construction tools, optimisation engines, strategy comparisons, backtests, simulations, risk diagnostics, allocation models, scenario analysis, and performance analytics.

These tools are designed to support research and understanding. They are based on assumptions, historical data, mathematical models, user inputs, and available market information. They may not reflect real-world execution costs, liquidity constraints, tax consequences, market stress, slippage, regulatory limits, product availability, or your personal circumstances.

Backtested, simulated, projected, or modelled performance is hypothetical and does not represent actual investment results. Past performance is not a reliable indicator of future results.

Investing involves risk. The value of investments can rise or fall, and you may lose some or all of your invested capital.

Holy Funds does not guarantee any return, income, capital protection, risk reduction, diversification benefit, or investment outcome.

7. No Execution, Custody, or Brokerage

Unless explicitly stated otherwise in a separate regulated agreement with an authorised third party, Holy Funds does not execute trades, transmit orders, hold client assets, provide custody, operate brokerage accounts, or manage money on behalf of users.

Any investment action you take outside the platform, including through a broker, bank, exchange, fund platform, or other third-party provider, is your own responsibility and is governed by the terms of that third party.

You are responsible for ensuring that your use of Holy Funds is lawful in your jurisdiction.

9. Platform Content

Holy Funds may display information relating to financial markets, asset classes, securities, ETFs, funds, companies, strategies, themes, economic indicators, risk metrics, and portfolio concepts.

This content may be derived from internal models, third-party data, public sources, user inputs, AI-generated outputs, or other available information. Holy Funds does not guarantee that any content is accurate, complete, current, or free from error.

We may change, update, remove, restrict, or discontinue any content, tool, feature, strategy, model, dataset, or platform section at any time.

10. Third-Party Data and Services

The platform may rely on third-party data providers, APIs, financial data sources, AI service providers, payment processors, analytics tools, brokers, custodians, or other external services.

Holy Funds is not responsible for the availability, accuracy, reliability, security, or performance of third-party services. Your use of third-party services may be subject to additional terms and privacy policies.

11. No Guarantee of Availability

We aim to provide a reliable platform, but we do not guarantee uninterrupted, error-free, secure, or continuous access to Holy Funds.

The platform may be unavailable due to maintenance, upgrades, technical issues, third-party outages, cyber incidents, data errors, or circumstances beyond our control.

Some features may require an account. You agree to provide accurate information, keep your login credentials secure, and notify us promptly of any unauthorised use of your account.

You are responsible for all activity under your account unless caused by our proven negligence or misconduct.

We may suspend or terminate accounts that violate these Terms, misuse the platform, attempt to bypass access controls, abuse AI features, scrape data, interfere with systems, or use the service unlawfully.

Holy Funds, including its design, software, research framework, platform structure, strategy architecture, text, graphics, analytics, models, workflows, branding, logos, and proprietary methodology, is owned by Holy Funds or its licensors.

You receive a limited, non-exclusive, non-transferable, revocable right to use the platform for your own personal or internal research purposes, subject to these Terms.

You may not copy, reproduce, distribute, sell, license, modify, or create derivative works from Holy Funds content or software without our prior written consent, except where expressly permitted by law.

You may submit information, preferences, portfolio data, financial assumptions, strategy selections, or other inputs into the platform.

You retain ownership of your own data, but you grant Holy Funds the right to process such data as necessary to provide the platform, generate analytics, operate tools, maintain security, improve services, and comply with legal obligations.

16. Subscriptions, Payments, and Access

Certain features may be available only through paid plans or subscriptions. Pricing, billing periods, included features, usage limits, and cancellation rules will be shown at checkout or within the platform.

Unless otherwise stated, subscription fees are charged in advance and may be non-refundable except where required by applicable consumer protection law.

20. Changes to the Platform or Terms

We may update these Terms from time to time. The updated version will be posted on the website with a revised “Last updated” date.

If we make material changes, we may notify you through the platform, by email, or by other reasonable means. Continued use of Holy Funds after changes become effective means you accept the updated Terms.

21. Termination

You may stop using Holy Funds at any time.

We may suspend, restrict, or terminate your access if you breach these Terms, misuse the platform, create legal or regulatory risk, fail to pay applicable fees, or use the platform in a way that may harm Holy Funds, other users, or third parties.

22. Governing Law and Jurisdiction

These Terms are governed by the laws of Austria, unless mandatory consumer protection rules in your country of residence require otherwise.

Subject to applicable consumer protection law, the courts of Vienna, Austria shall have jurisdiction over disputes arising from or relating to these Terms or your use of Holy Funds.
